LCO No. 66181of 71General AssemblyRaised Bill No.1113January Session, 2019LCO No. 6618Referred to Committee on JUDICIARY Introduced by:(JUD)AN ACT CONCERNING THE RECOMMENDATIONS OF THE CONNECTICUT SENTENCING COMMISSION WITH RESPECT TO THE SEXUAL OFFENDER REGISTRY, PETITIONS TO TERMINATE PARENTAL RIGHTS OF INCARCERATED PARENTS AND SENTENCE REVIEW.Be it enacted by the Senate and House of Representatives in General Assembly convened:Section 1.Section 54-250 of the general statutes is repealed and the 1following is substituted in lieu thereof (Effective October 1, 2019):2For the purposes ofthis section, sections 2 to 6, inclusive, of this act, 3section 13 of this act, sections 17 to 20, inclusive, of this act, and4sections 54-102g and [54-250]54-251to 54-258a, inclusive, as amended 5by this act:6(1)”Conviction” means a judgment entered by a court upon a plea of 7guilty, a plea of nolo contendere or a finding of guilty by a jury or the 8court notwithstanding any pending appeal or habeas corpus 9proceeding arising from such judgment.10(2)”Criminal offense against a victim who is a minor” means (A) a 11Raised Bill No.1113LCO No. 66182of 71violation of subdivision (2) of section 53-21 of the general statutes in 12effect prior to October 1, 2000, subdivision (2) of subsection (a) of 13section 53-21, subdivision (2) of subsection (a) of section 53a-70, 14subdivision (1), (4), (8) or (10) or subparagraph (B) of subdivision (9) of 15subsection (a) of section 53a-71, subdivision (2) of subsection (a) of 16section 53a-72a, subdivision (2) of subsection (a) of section 53a-86, 17subdivision (2) of subsection (a) of section 53a-87, section 53a-90a, 53a-18196a, 53a-196b, 53a-196c, 53a-196d, 53a-196e or 53a-196f, (B) a violation 19of subparagraph (A) of subdivision (9) of subsection (a) of section 53a-2071 or section 53a-92, 53a-92a, 53a-94, 53a-94a, 53a-95, 53a-96 or 53a-186, 21provided the court makes a finding that, at the time of the offense, the 22victim was under eighteen years of age, (C) a violation of any of the 23offenses specified in subparagraph (A) or (B) of this subdivision for 24which a person is criminally liable under section 53a-8, 53a-48 or 53a-2549, or (D) a violation of any predecessor statute to any offense specified 26in subparagraph (A), (B) or (C) of this subdivision the essential 27elements of which are substantially the same as said offense.28(3) “Highest-risk offender” means an offender who has been 29assessed and determined by a placement panel of the Sexual Offender 30Registration Board under section 2of this act to pose a high risk to 31reoffend sexually or violently.32[(3)](4)”Identifying factors” means fingerprints, a photographic 33image, and a description of any other identifying characteristics as 34may be required by the Commissioner of Emergency Services and35Public Protection. The commissioner shall also require a sample of the 36registrant’s blood or other biological sample be taken for DNA 37(deoxyribonucleic acid) analysis, unless such sample has been 38previously obtained in accordance with section 54-102g.39(5)”Law enforcementagencyregistry” means the registry for which 40registration is required pursuant to section 3 of this act.41(6) “Lowest-risk offender” means an offender who has been assessed 42and determined by a placement panel of the Sexual Offender 43
